Terms and Conditions
All applications submitted by Clients with The Visa Butler are made and accepted subject to the terms and conditions hereinafter set out. No servant or agent of The Visa Butler is permitted to vary these terms unless authorised in writing to do so by the directorate of The Visa Butler.
These terms and conditions govern the provision of all and any services provided for by The Visa Butler in respect of but not limited to the obtaining of visas, passports and/or documents for their clients and all orders places by their clients are made and accepted subject to the terms hereinafter set out.
The Visa Butler will use its best endeavors to process applications for visas, passports and/or documents at the client’s request. However, The Visa Butler shall not be held responsible nor accept any liability for the actions of any consulate, embassy, passport office or subcontracted couriers, servants or agents in delaying or not issuing such applications for any reason whatsoever, nor shall The Visa Butler be held responsible for expense and/or delay arising from or in connections with incomplete applications forms/incorrectly or falsely completed application forms/inaccurate or incomplete supporting documentation. Any expense or cost incurred by the client due to these delays or non-issuances shall not be the responsibility or, nor shall any changes be levied upon The Visa Butler. Tickets for travel should not be purchased prior to the visa/passport being issued unless they are a specific requirement for that consulate and in such cases open/refundable tickets should be obtained.
The Visa Butler provides carefully complied visa and passport information in good faith on the express understanding that the said information is the interpretation of any or all information provided by the respective embassies, consulates or passport offices at any or all times and The Visa Butler shall not accept responsibility or liability whatsoever for any errors and/or omissions in the information.
The Visa Butler will endeavour, wherever possible, to process the clients visa, passport and/or document on the instructions given and application forms submitted, although it is the clients express responsibility to ensure that the validity of the said visa/passport/document obtained includes and covers the period of time in which the client plans to enter and leave the country or countries that the client is visiting and for the number of entries to that country and is valid for the purpose intended.
Should a passport, document or other item be lost, misplaced, damaged, delayed or destroyed by any means whatsoever, including any acts by subcontracted couriers, servants or agents, the cost of replacing same and/or any consequential loss shall be borne by the client and any contribution to the costs by The Visa Butler will be entirely at the discretion of the directorate of The Visa Butler.
The fee shall be payable by the client in respect of the services provided by The Visa Butler and is exclusive of any consular charges. Such consular or embassy charges as may be made will be the absolute liability of the client who much make payment in respect of those charges. The Visa Butler reserves the right to raise its charges at any time with or without prior notice. Payment of The Visa Butler is due together with any anticipated consular or embassy charges upon The Visa Butler being instructed unless account facilities have been agreed in writing prior to the said instructions.
Unless instructions are made in writing The Visa Butler shall not be held responsible for taking such steps as are reasonable considered as fulfilling the implied instructions of the clients and/or as being in the best interest of the client and any charges for such services rendered shall be wholly the responsibility of the client.
The Visa Butler reserves the right to retain all passports and documents until payment of the aforementioned amounts is received in full. In the event of non-payment all visas obtained by The Visa Butler will be cancelled and the Passport returned to the authorities of the Passport issuers country.
The Visa Butler reserves the right to refuse at its total discretion to handle any application or carry and item at any times and no reason need be given, and to amend the terms and conditions as it deems necessary.
Each of the above conditions shall be read and construed independently of each other so that if one or more is held to be invalid as an unreasonable restraint of trade, or for any other reason whatsoever, then the remaining Terms & Condition shall be valid to the extent that they are not held to be invalid. Further, in the event that any Term and Condition shall be found to be void but will be valid if some part thereof were deleted, then such Term and Condition shall apply with such modification as may be necessary to make it valid and effective. The failure by The Visa Butler at any time or for any period to enforce any one of ore of these Terms & Conditions shall not be a waiver of them, or a waiver of the right to enforce such Terms & Conditions on a future occasion.
These Terms & Conditions shall be governed by and constructed in accordance with the laws of England.
